Please read these Terms carefully before using ToxAI. By accessing or using the app, you agree to be bound by them.

Acceptance of these terms

These Terms of Use ("Terms") govern your access to and use of the ToxAI mobile application (the "Service"), operated by Artur Tsormaev ("we", "us", or "our"). They apply to everyone who accesses or uses the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of them, you may not use the Service.

Use of the app

You agree to use ToxAI only for lawful purposes and in line with these Terms. You will not misuse the Service, attempt to interfere with its normal operation, reverse engineer it, or use it in any way that could harm us, other users, or any third party.

Subscriptions & billing

ToxAI offers auto-renewable subscriptions. Purchases are processed by Apple and billed to your Apple ID. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.

You can view and manage your subscription, or turn off auto-renewal, in your device's Account Settings. The full subscription terms — including periods, pricing, and renewal details — are set out in our Privacy Policy, and your purchase is also subject to Apple's Media Services Terms.

Availability, errors and inaccuracies

We are constantly updating ToxAI and its offerings. Information in the app, including pricing and feature descriptions, may occasionally be inaccurate, incomplete, or out of date, and we may experience delays in updating it. We cannot guarantee the accuracy or completeness of any information and reserve the right to correct errors, inaccuracies, or omissions, and to change or update information, at any time without prior notice.

Intellectual property

The Service and its original content, features, and functionality are and will remain the exclusive property of Artur Tsormaev and its licensors. The Service is protected by copyright, trademark, and other laws of Kazakhstan and other countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

The Service may contain links to third-party websites or services that we do not own or control, such as Apple's support and account pages. We are not responsible for the content, privacy practices, or policies of any third-party sites, and we encourage you to review their terms before using them.

Third-party trademarks & non-affiliation

ToxAI is an independent app. It is not affiliated with, endorsed by, sponsored by, or in any way officially connected with Instagram or TikTok, or with any of their parent companies, subsidiaries, or affiliates.

"Instagram" is a trademark of Meta Platforms, Inc., and "TikTok" is a trademark of ByteDance Ltd. All product names, logos, and brands referenced in the app or on this page are the property of their respective owners. Any reference to them is made for identification and descriptive purposes only and does not imply any association with or endorsement by those companies. You are responsible for complying with the terms of service of any third-party platform you use alongside ToxAI.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason — including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Limitation of liability

To the maximum extent permitted by law, in no event shall Artur Tsormaev, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, use, or goodwill — resulting from (i) your access to or use of, or inability to use, the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorised access, use, or alteration of your content, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damage.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or available at any particular time; that defects will be corrected; that it is free of viruses or other harmful components; or that results from using it will meet your requirements.

Governing law

These Terms are governed by and construed in accordance with the laws of Kazakhstan, without regard to its conflict-of-law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to these terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice before the new terms take effect. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the Service.
